BookBarista is subject to the following Terms of Service Use ("TOSU"). By using BookBarista you agree to comply with the TOSU. In addition, when using BookBarista services, you agree to abide by any posted guidelines.
BookBarista has the right, but is not obligated, to enforce the TOSU from moderation on up to prosecution.
MODIFICATIONS TO THIS AGREEMENT:
We reserve the right, at our sole discretion, to change or modify these terms and conditions at any time. You must review this agreement on a regular basis to keep yourself apprised of changes.
CONTENT:
You understand that all postings, messages, text, files, images, photos, or other materials posted on, transmitted through, or linked from the service, are the sole responsibility of the person from whom such items/content originated.
You are responsible for each individual item/content that you post, email or make available via the service. BookBarista does not control, and is not responsible for items/content made available through the service
BookBarista will not be liable for any items/content or for any loss or damage of any kind as a result of the use of any items/content posted, emailed or made available.
THIRD PARTY CONTENT, SITES, AND SERVICES:
You should make whatever investigation appropriate before proceeding with any transaction with any third parties. BookBarista will not be held liable for any dealings/representations you make with anyone, including third parties.
BookBarista is under no obligation to become involved in any dispute between any parties on this site.
CLAIMS OF INFRINGEMENT:
If you believe your work has been copied, constituting copyright infringement, notify BookBarista of copyright or intellectual property infringement, at:

Provide the following:
1.) Identify the material on the BookBarista site that you claim is infringing;
2.) A statement by you that you have a good faith belief that the disputed use is not authorized;
3.) A statement by you declaring under penalty of perjury that (a) the above information in your Notice is accurate, and (b) that you are the owner of the copyright interest involved or you are authorized to act on behalf;
4.) Your address, telephone number, and email address; and
5.) Your physical or electronic signature.
BookBarista will remove the posting(s) of contention if found to be infringing.

Your use of BookBarista signifies acknowledgement and agreement to our Privacy Policy.
CONDUCT:
You agree not to make available items/content:
1.) that is unlawful or harmful in any way;
2.) that violates any country, state or local law prohibiting discrimination;
3.) that violates federal, state, or local equal employment opportunity laws;
4.) that contains pornographic images;
5.) that contains pornographic images of children or material exploitative of children;
5.) that includes personal information about another person without that person`s consent;
6.) that is false;
7.) that infringes any patent, trademark, trade secret, copyright, proprietary rights, or contract;
8.) that contains tips or instructions on how to break or circumvent DRM-protected content;
9.) that constitutes "affiliate marketing", "link referral code", "junk mail", "spam", "chain letters", "pyramid schemes", or unsolicited commercial advertisement;
10.) that advertises any illegal service or the sale of illegal items;
11.) that contains software viruses or programs designed to interrupt or limit software or hardware;
12.) that employs misleading data to disguise the origin of content.
You agree not to:
1.) contact anyone who wishes not to be contacted or make unsolicited contact for commercial purposes;
2.) harass anyone;
3.) collect personal data about users for commercial or unlawful purposes;
4.) use automated means, including spiders, data mining tools, etc. to download data from the site;
5.) post irrelevant items/content or repeatedly post the same or similar items/content;
6.) attempt to gain access to BookBarista's`s systems or attempt to harm the site;
7.) use any form of automated device that enables the submission of postings on BookBarista without each posting being manually entered by the poster;
8.) use any form of flagging tool to remove posts of competitors.
POSTING AGENTS:
A Posting Agent is a third-party agent that offers to post items/content to the site on behalf of others. These are not allowed!
NO SPAM POLICY:
Spam violations may subject the sender and his or her agents to civil and criminal penalties. Don`t do it!
LIMITATIONS ON SERVICE:
You acknowledge that BookBarista may establish limits concerning use of the service, including duration of use and size of posts.
ACCESS TO THE SERVICE:
BookBarista grants you a limited, revocable, nonexclusive license to access the service for your own personal use within the TOSU guidelines. This license does not include any duplication of the service or use of data gathering/extraction tools.
Use of the site beyond the scope of authorized access immediately terminates your service privileges.
TERMINATION OF SERVICE:
BookBarista has the right to delete or deactivate your account, block your email or IP address without notice, and remove and discard any items/content for any reason.
PROPRIETARY RIGHTS:
This service is protected by copyright laws and international treaties.
You automatically grant, represent, and warrant that you have the right to grant, to BookBarista an irrevocable, fully paid, worldwide license to use, copy, perform, display, and distribute your content and to prepare derivative works of, or incorporate into other works, your content, and to grant and authorize sublicenses of the foregoing.
By posting items/content to the site, you automatically grant BookBarista all rights to prohibit any subsequent copying or duplication of the items/content on the site by any party for any purpose.
DISCLAIMER OF WARRANTIES:
You agree using BookBarista is entirely at your own risk. The BookBarista site and the service are provided on an "as-is" basis, without any warranties or guarantees of any kind.
LIMITATIONS OF LIABILITY:
Under no circumstances shall BookBarista be liable for direct, indirect, incidental, special, consequential, or exemplary damages.
INDEMNITY:
You agree to indemnify and hold BookBarista, its officers, subsidiaries, affiliates, successors, assigns, directors, officers, agents, service providers, suppliers and employees, harmless from any claim or demand arising out of items/content submitted.
GENERAL INFORMATION:
The TOSU constitutes the entire agreement between you and BookBarista. The TOSU and the relationship between you and BookBarista shall be governed by the laws of the State of California. You and BookBarista agree to submit to the personal and exclusive jurisdiction of the courts located in the city of Vallejo, California.
VIOLATION OF TERMS AND LIQUIDATED DAMAGES:

You agree to pay BookBarista's actual damages, to the extent such actual damages can be reasonably calculated.
